The new General Data Protection Regulation (GDPR) came into effect on 25th May 2018.
Trustworthiness and transparency have never been more important. Our founder Angel Maldonado explains why GDPR is so important and how retailers need to empower shoppers with a sense of control and confidence.
The Directive is intended to harmonize the various data protection laws across the EU through the application of a single data protection law that is binding throughout each member state.
What will it do?
The directive lays down rules relating to the protection of the fundamental rights and freedom of people with regards to the processing, free movement and protection of personal data. It replaces the existing Directive 95/46/EC.
What does it mean?
Effectively, any organization with an establishment in the EU or offering goods or services to citizens in an EU state is required to process the Personal Data of EU residents according to this directive.
How does this impact EmpathyBroker?
EmpathyBroker’s philosophy since inception has always been privacy and transparency by design to ensure that shoppers are permanently in control of their data.

As a Personal Data Processor, our EmpathyInterface, EmpathySearch and EmpathyInsights products are all GDPR.Broker enabled. This means they all comply to the new regulations to ensure and facilitate the execution of individuals rights when Unique Identifiers are processed, such as:
- Requests by a Unique Identifier for the uses and purposes of any Profiling Data.
- Compliance with the Right to Access, Update, Delete, Restrict, Port, Object and Be Informed regarding all individual automated decision-making processes.
We also only use personal data for the purposes outlined at the consent points, and all three products can operate without using personal data if consent is not given.
How do the new regulations affect search & browse?
There are many aspects such as Interfaces, APIs and Reports that are not affected but some features such as Personalisation may use identifiers that can be linked to a person, therefore recognised as personal data, in order to profile and understand user behaviour and context for more personalised results.
Does EmpathyBroker NEED Personal Data?
No! The good news is all our products can function without the use of personal data. We use data within some features to provide a better experience but this can be based on collective data to avoid one to one profiling data.
